NEBRASKA RIGHT TO LIFE MOURNS PASSING OF PAST PRESIDENT
 
LINCOLN---Long-time Nebraska Right to Life Board member and immediate Past President Sarah O'Mara of Eddyville died on May 20th. 
 
"The Nebraska Right to Life Board of Directors mourns the passing of our friend Sarah O'Mara who dedicated her life to the pro-life cause," said Julie Schmit-Albin, NRL Executive Director. "Sarah's commitment to defending the innocent went beyond that of the average pro-life activist. Since the age of 13 she was confined to a wheelchair but spent her adult life in dogged determination to restore protection to the unborn.  It was not unheard of for Sarah to go from car to car in her wheelchair, distributing our Voter Guides in election time. She didn't let anything stop her and we will miss her greatly."
 
Sarah had served as NRL President for the past three years up until illness forced her to resign in March. She still remained on the NRL Board, where she had been a member since the mid-1980's.
 
Sarah's funeral will be at St. Anne's Catholic Church in Lexington, Nebraska on Friday.

NATIONAL RIGHT TO LIFE "DEEPLY SADDENED"
BY THE DEATH OF TERRI SCHIAVO

National Right to Life joins with countless others worldwide in expressing sympathy to the Schindler family over the death of Terri Schiavo. Terri died of starvation and dehydration today, nearly 13 days after her feeding tube was removed under court order. The following statement may be attributed to Burke Balch, J.D., Director of the Robert Powell Center for Medical Ethics at the National Right to Life Committee:


"We are deeply saddened by Terri's death and extend our heartfelt sympathy to the Schindler family. Terri Schiavo's death is a gross injustice and it marks a sad day in our history when our society allows Terri and others like her who have severe disabilities to be discarded in such a cruel and inhumane manner.

We must redouble our efforts to protect those with disabilities. We will continue working to ensure that they are not dismissed by some "quality of life" standard which dictates that some lives are less worthy than others.

National Right to Life is promoting a pro-life living will called the 'Will to Live' for those who wish to make sure they are not put to death by starvation and dehydration. It is important to recognize that many standard living will forms are written to reject food and fluids, not to insist on them and we encourage people to consider signing a pro-life living will."

PRO-LIFE WINS OVER ALL

 
Lincoln-----Out of 25 federal and state candidates endorsed by Nebraska Right to Life Political Action Committee (NRL PAC), 18 candidates won in yesterday's General Election, according to Julie Schmit-Albin, NRL Executive Director.
 
"Our major win was the likely re-election of President George Bush", said Schmit-Albin.  "The fate of future U.S. Supreme Court appointments should now lie in the hands of a committed pro-life President.  The number one priority of the pro-life movement was the re-election of President Bush and God-willing, that has been accomplished."
 
Other major wins in Nebraska were the election of Jeff Fortenberry to the 1st Congressional District seat and the return of Lee Terry to his seat in the 2nd District. 
 
"With the election of Fortenberry, pro-lifers in the 1st District will no longer have to wonder if their Congressman will consistently come down on the side of pro-life issues." said Schmit-Albin.
 
There were five total pro-life gains in contested races, including two likely pick-ups in the Nebraska Legislature.
 
"My personal favorite was the ousting of the University of Nebraska Board of Regents Chairman Don Blank in the 7th District in favor of Dave Hergert who is committed to the pro-life agenda on unethical research issues that will continue to come before the Regents." said Schmit-Albin.  Hergert joins Randy Ferlic and Howard Hawks as the third pro-life candidate elected to the Board of Regents since 1999 when it was revealed that the University of Nebraska Medical Center was conducting research using aborted fetal tissue. 
 
She also cited stronger pick-ups in two state legislative districts. 
 
" A number of the races were a wash for us because a pro-life incumbent was leaving and a pro-lifer was elected." said Schmit-Albin. "However, in Districts 23 and 45 we should have solid pro-lifers in Chris Langemeier and Abbie Cornett, where their predecessors, Curt Bromm and Paul Hartnett left us on some bioethics votes."
 
Schmit-Albin also noted a pick-up in the District 3 State Board of Education seat with the election of Jim Scheer.

NEBRASKA RIGHT TO LIFE STATEMENT ON JUDGE KOPF'S DECISION RE: PARTIAL-BIRTH ABORTION BAN

 
Judge Richard Kopf's decision finding the federal Partial-Birth Abortion Ban unconstitutional will continue the appeals process of the federal government until this issue reaches the U.S. Supreme Court again, said a spokesperson for Nebraska Right to Life.
 
"Judge Kopf said his ruling upholding partial-birth abortions did not apply in cases of viable babies," said Julie Schmit-Albin, NRL Executive Director.  "However, a good number of those babies who are aborted by this grisly procedure are indeed viable.  It seems incongruous to state that partial-birth abortion is constitutionally protected on one hand; but ignore how it is being practiced in this country on the other hand." 
 
"If this is ostensibly about protecting the health of a pregnant woman let's look a little more closely at who the provider is." said Schmit-Albin.   "Nebraska's partial-birth abortionist, LeRoy Carhart, is not an OB-GYN and according to court testimony, he didn't even have hospital privileges.  I wouldn't go into his facility for a tatoo, much less invasive medical surgery." 
 
"Congress has spoken and a majority of the American people oppose partial-birth abortion." said Schmit-Albin. "These three rulings in San Francisco, New York and Lincoln will intensify the response of pro-life voters at the ballot box this November.  The possibility of future Supreme Court appointments lies in the balance."

RE: DISMISSAL OF FELONY CHARGE AGAINST JULIE SCHMIT-ALBIN, EXECUTIVE DIRECTOR OF NEBRASKA RIGHT TO LIFE

Julie Schmit-Albin, Executive Director of Nebraska Right to Life, has enrolled in Lancaster County’s Pretrial Diversion Program. She chose to participate in pretrial diversion in order to expedite the dismissal of the felony charge filed against her on December 20, 2002. The publicity generated by the charge has needlessly damaged her reputation and has traumatized her family. They have endured much stress and uncertainty over this situation since August, 2002, when the police investigation began. Enrolling in Pretrial Diversion to have the charge dismissed was a welcome choice in order to restore tranquility to their lives.

Thus far, the media coverage of this case has displayed a misunderstanding regarding something as simple as the charge itself. The media reports suggest that Ms. Schmit-Albin has been accused of illegally accessing e-mails and voice mails. However, she was accused only of illegally accessing voice messages, pursuant to Nebraska Revised Statute 6-702(1). This statute is commonly referred to as the wiretap statute. The statute makes it a crime for someone to unlawfully intercept or attempt to intercept telephone conversations or telephone messages. Ms. Schmit-Albin has never been charged with illegal interception of e-mail or "computer hacking" as one newspaper mistakenly reported.

The police investigation in this case discloses that from April 2002, until August, 2002, Ms. Schmit-Albin received numerous e-mails from an anonymous source, providing her with inside information regarding activities at Planned Parenthood. After the e-mail communications ended, a police investigation revealed the identity of the anonymous sender as John Keller, a former employee of Planned Parenthood. While communicating with Ms. Schmit-Albin, Keller repeatedly refused to identify himself, even upon explicit requests to say who he was. The information he provided included the names and phone numbers for most of the Lincoln Planned Parenthood employees. He also provided a voice mail access code and encouraged Ms. Schmit-Albin to use it to listen to phone messages. She flatly refused to do so. Additionally, he claimed to have access to keys to the Lincoln Planned Parenthood facilities and offered to give them to Ms. Schmit-Albin. She again refused his offer. Throughout the e-mail communications, it was apparent that the anonymous sender had unrestricted access to all of the phones and computers at Planned Parenthood, as well as access to the Planned Parenthood facilities themselves.

The police investigation did not reveal any evidence to suggest that Ms. Schmit-Albin herself intercepted any telephone communications. The prosecution’s theory was that she aided and abetted Keller’s commission of unauthorized voice mail access. To convict her, it would be necessary to prove that she actually knew Keller was committing a crime. It would also be necessary to prove that, knowing that he was committing a crime, she encouraged him to do so. The police investigation did not reveal any evidence to prove either actual knowledge that a crime was occurring or any encouragement. Rather, the police investigation revealed that Ms. Schmit-Albin expressed serious concerns when Keller anonymously provided her with a voice mail access code and told her to use it. She responded, saying she would not use the voice mail access code and that she did not wish to do anything that would be illegal. The most reasonable inference that can be drawn from all of the information available is that Keller, by providing detailed information anonymously, was in all likelihood a Planned Parenthood employee with unrestricted access to all phones, computers and other information at Planned Parenthood.

"The Board of Directors of Nebraska Right to Life stands behind our Executive Director Julie Schmit-Albin in the wake of proceedings entered in Lancaster County District Court last Friday." said Sarah O'Mara of Eddyville, President of Nebraska Right to Life.

"Julie notified the Board last May of the anonymous informant who was sending her e-mail communications regarding possible violations of state and federal regulations at Planned Parenthood-Lincoln." said O'Mara. "She also sent us the letter she sent to four agencies in May, noting the possible violations by Planned Parenthood and has kept us apprised of the situation. She forwarded several of the e-mails in June to five reporters; three at the Lincoln Journal-Star and two at the Omaha World-Herald.  She sought and relied on legal counsel's advice after the informant asked her to access a voice mail; which she did not do. She notified all of our local chapters about the informant's e-mails in September after the investigation began by the Lincoln Police Department."

"Julie has conducted herself with the utmost integrity for the nearly 14 years that she has been Executive Director of NRL," said O'Mara. "We have no reason to believe that she has departed from her longstanding commitment to legal activities on behalf of the pro-life movement and fully support her as she faces this charge.

RE: Possible Violations Of Regulations At Planned Parenthood-Lincoln

Dear Mr. Ross:

I have received a number of communications recently regarding possible violations of state regulations by Planned Parenthood-Lincoln. While the source of these complaints has contacted me anonymously, I have reason to believe that this person is credible and that the allegations have substance. I am not in the practice of dredging up false accusations simply for the exercise of having Planned Parenthood investigated. Therefore, as this source has continued to contact me with their concerns, I thought it best to bring them to your attention.

These complaints are not accompanied by time, date, location or eye-witness account because they have been communicated to me anonymously by someone whom I believe has inside knowledge of the workings of Planned Parenthood. When pressed for such details the source would not provide them; I believe due to the fact that such source would be putting themselves or their informant at risk of retribution from Planned Parenthood.

In good conscience I did not think it proper to withhold these allegations from your scrutiny; even though I do not have all of the details that you might need to initiate an investigation. Also, please forgive my lack of knowledge as to which proper department of DHHS these accusations should be addressed.

I do not know in every complaint which Planned Parenthood location (23rd & "O" St. or 37th & South abortion facility) is being cited, although it is obvious in a couple cases. I am also certain that some of the complaints may fall under federal OSHA regulations or are under the purview of the State Pharmacy or Insurance Boards. Here are the main concerns that have been raised:

***Falsifying records ("O" St.) in preparation for a DHHS inspection because charts were not "in order."

***Pharmacy operating without a professional, licensed person on site, particularly over the noon hour when dispensing medication. Operating with non-professional, poorly trained, unlicensed personnel dispensing birth control pills and antiobiotics and unqualified personnel supervising the laboratory.

***Not reporting when the wrong medications and/or birth control pills have been issues.

***Not having staff who are CPR-certified working in a state licensed health care facility.

***Violations in the lab at the abortion facility which is supposed to be federally licensed and supervised.

***Recurring problems with filing and collecting insurance, i.e. errors in not filing correctly, mis-filing and possibly duplicate filing and/or filing using the wrong medical code numbers.

***Possible violations with regard to:

--Waste material disposal.

--Failure to document annual training for bloodborn pathogens.

--Improper disposal/storage of contaminated needles.

--Deficiencies in posting mandated OSHA signage.

Since I do not have knowledge of which agency/board in particular deals with which allegations, I have taken the liberty of copying this entire letter to all that might have some area under their purview.

I look forward to hearing a response as to which of these allegations might be investigated under the auspices of DHHS.

UNMC’S CLAIM ON REDUCTION OF FETAL TISSUE USE IS OLD NEWS AND POSTURING

LINCOLN----The University of Nebraska Medical Center’s (UNMC) claim that it has reduced its dependency on aborted fetal tissue is old news and represents a reaction to the recent election and posturing before the next legislative session, according to Julie Schmit-Albin, Nebraska Right to Life Executive Director.

"In December, 2001 UNMC issued a report to state senators entitled, "UNMC Alternative Sources Update" which claimed that UNMC had reduced its dependency on aborted fetal tissue for research by 40 percent due to its rapid autopsy program." said Schmit-Albin, "Coincidentally, that report came out prior to the opening of the January legislative session as this latest report has, claiming a reduction of 65 percent since 2000. This is just further regurgitation of the first report in anticipation of the upcoming legislative session."

"The only thing this latest report proves is that UNMC can count and they don’t like the results of the recent election where we made a net gain of three new pro-life senators who oppose unethical research," said Schmit-Albin. "What UNMC fails to address in its latest attempt at damage control is what their plans are for destructive embryonic stem cell research and cloning for research."

"Pro-life Nebraskans will not be swayed by any amount of posturing from UNMC regarding unethical research." said Schmit-Albin. "Ask the anti-death penalty movement if they would pack up and go home if the State executed only 35% of the death row inmates. I rather doubt it and the pro-life movement is no different when it comes to standing on principle."

The NU Bioethics Advisory Committee approved guidelines in May, 2001 for embryonic stem cell research and the NU Board of Regents voted to affirm those guidelines in September, 2001. UNMC nor the NU Bioethics Advisory Committee has ever made any definitive statement about their positions on cloning for medical research.

 PRO-LIFE NET GAIN IN LEGISLATURE & BOARD OF REGENTS

LINCOLN----Nebraska Right to Life endorsed candidates who won in the General Election will increase the net gain of pro-life senators  in the Legislature by three and possibly up to five; adding two more candidates who were not endorsed but who have pro-life positions.  All five have expressed opposition to immoral research, which has become a key issue in the Legislature.   In addition, a pro-life gain was made on the NU Board of Regents with the election of Howard Hawks in District 2.  Another race still in question is the District 1 Regents race where NRL endorsed candidate Tony Ojeda may be in a recount with incumbent Charles Wilson.

#10  Mike Friend (NRL endorsed) over Deb Suttle who was not voting pro-life on fetal tissue ban.

#49  LeRoy Louden, replaces Bob Wickersham’s seat, Wickersham was not voting pro-life on fetal tissue ban.  Senator Fred Hlava had been appointed and endorsed by NRL but had no opportunity to vote on ban.  Louden responded pro-life on immoral research questions on another pro-life survey.

NEBRASKANS FOR RESEARCH POLL SKEWED AND BETTER YET; WHERE DO THEY AND UNMC STAND ON CLONING???

 
"If Nebraskans for Research want to delude themselves into thinking that their skewed poll questions show support for research cannibalizing aborted babies; they can do so." said Julie Schmit-Albin, Executive Director of Nebraska Right to Life.  "Their questions are biased so as to elicit the response they want; which is not unheard of in polling."
 
"In addition, who are the 800 people they polled and how did they ascertain a segment of them to be Catholic and pro-life?" said Schmit-Albin. "There's a world of difference between 'practicing' Catholics and those who are Catholic in name only.  Likewise, plenty of people consider themselves 'pro-life' who in reality, don't support true pro-life principles.  As we have seen from numerous politicians who call themselves 'pro-life', it can encompass the whole gamut, from people who support abortion for several reasons to those who are strongly opposed to any abortions."
 
"We in turn ask Nebraskans for Research; what is their official position on cloning for research and reproductive purposes?" said Schmit-Albin. "How can an entity that exists to support medical research not have a position on cloning?  Better yet, how can their friends at UNMC not have a position on cloning when UNMC is currently using aborted babies for research and is poised to begin embryonic stem cell research? How does Nebraskans for Research know that another bill to ban aborted fetal tissue research will be introduced in the next legislative session when all of the attention in the Senate is centered on two cloning bans; one true ban introduced by Senator Sam Brownback and one bogus ban introduced by Senator Dianne Feinstein?"

 PRESIDENT’S COUNCIL ON BIOETHICS REPORT NOT COMFORTING

Lincoln---The President’s Council on Bioethics Report recommending a four year moratorium on cloning of human embryos for medical research had a mixed reaction from Nebraska Right to Life.

"The Bioethics Council agreed on one topic which 99% of Americans probably concur with; we don’t want clones of ourselves walking around. That’s the easy part. Unfortunately, there was no majority consensus on creating human clones for the express purpose of killing them for medical research. It’s alarming to us that only seven members of the Council see an immediate need to ban cloning for research." said Julie Schmit-Albin, Executive Director of Nebraska Right to Life.

Those seven members joined with three others to form a majority position recommending a four year moratorium on research cloning. That left a seven member minority of the Council pushing for research cloning.

"Out of an 18 member council, seven see the need to ban cloning for research and seven want it to continue. That is very unsettling."said Schmit-Albin. "We don’t advocate moratoriums as a solution. It favors the biotech companies and universities; which may seize upon cloning advances in other countries not under a moratorium. Unfortunately, if we don’t have the votes in the Senate; the only recourse would be to support Senator Sam Brownback’s call for a two year moratorium on cloning."

"Right now the battle is over the bogus ‘clone and kill’ bill in the Senate being promoted by Senators Hatch, Feinstein and Harkin, Daschle and others." said Schmit-Albin. " Our task at hand is to defeat the bogus cloning legislation and continue to push for a true ban on cloning for research."

Recently it was announced that Planned Parenthood of Lincoln and Planned Parenthood of Omaha-Council Bluffs are merging.  An interesting aside to this story is that PP-Lincoln's budget is $1.8 million a year and PP-Omaha-Council Bluff's budget is $2.8 million a year.  That's just one year!  Imagine what Nebraska Right to Life and the pro-life movement could do with a million dollars a year; not to mention two million! 
 
We could reach thousands of Nebraskans with the sanctity of life message through tv, radio and newspaper advertising.  One of those messages would be to plaster every crisis pregnancy phone number within the area in places where at risk young women could find the information.  We could supply every private school that wanted it with appropriate respect life videos and books.  We could reach every pro-life voter in the State with our Pro-Life Voter Guide, through the mail.  We could ensure that each of those voters is actually registered to vote that year; will get their friends and family registered and we could call all of them the night before an election to make sure they actually go and vote.
 
Yet ironically, while these two Planned Parenthoods join forces to strengthen their finances and possibly extend abortion into areas of the State where there are no abortion facilities; the pro-life movement in Nebraska continues to struggle financially.  There is not one pro-life group that I am aware of; either locally or nationally, that has not experienced a downturn in funding since September 11th.  Many other charities outside of the pro-life movement are also struggling.  But the Planned Parenthood Federation of America and its affiliates continue along; thanks in large part to our tax dollars.

LINCOLN---Bellevue abortionist LeRoy Carhart is listed as a staff physician on the web site of Women’s Health Care Services; the abortion facility in Wichita, Kansas owned by late term abortionist George Tiller.

"Nebraska’s most notorious abortionist, Carhart, has hung out his shingle with the nation’s most notorious partial-birth abortionist, Tiller."said Julie Schmit-Albin, Nebraska Right to Life Executive Director. "Carhart claims to do abortions through all ‘legal’ stages in Nebraska; we wonder what he does when he is in Tiller’s facility which is known for committing the latest term abortions in the country."

"We know that the language in Doe v. Bolton (the companion case to Roe v. Wade) defines health so broadly as to allow abortion for any reason at any stage of development and that is what allows George Tiller to commit abortions through the last trimester of pregnancy," said Schmit-Albin. "Nebraska Right to Life begs the question; is LeRoy Carhart committing abortions in Kansas well into the third trimester; even though he claims to be limiting himself to the point of viability in Nebraska? GROUP LOOKING AT 2004 ELECTION CYCLE FOR INITIATIVE PETITION DRIVE

LINCOLN---Nebraska Right to Life (NRL) is moving an initiative petition drive to impact the rules of the Legislature to the 2004 election instead of attempting to get the signatures required by July, 2002 for this year’s General Election.

NRL polled its newsletter membership this past January about the possibility of using the initiative petition process to impact the number of votes it takes to invoke cloture in the Legislature. Currently, the legislative rules dictate that 33 votes are needed to invoke cloture to shut off a filibuster. NRL is looking to impact that by proposing an amendment to the State Constitution to lower that number.

"While we had grassroots pro-life activists who responded that they were willing to proceed this year, we have not been able to pull together the coalition of other interested groups who would support an initiative." said Julie Schmit-Albin, NRL Executive Director. "The NRL Board feels strongly that this effort should not be borne just on the backs of the pro-life movement. We will continue to try to build a broad coalition of other groups and individuals who would benefit from this approach. It is important that this effort be properly funded and supported by a cross section of Nebraskans who are as frustrated as we are with the 33 vote standard to end a filibuster and get to a vote on a bill."

Toward that end, NRL will attempt to identify and encourage other organizations and individuals to join the effort for the 2004 election. The first goal is to form a separate steering committee made up of individuals from other groups who could then form a ballot committee and submit already written language to the Secretary of State for the 2004 election.

"Our goal is to spend the next year putting that in place and preparing for the circulating of petitions to begin in the summer of 2003 and to continue until the deadline in July of 2004." said Schmit-Albin.

NELSON, HAGEL AND TERRY GOT IT RIGHT ON CAMPAIGN FINANCE REFORM

1st Amendment Restrictions Concern Citizen Groups

LINCOLN---Nebraska Right to Life today praised the vote of Congressman Lee Terry against the Shays-Meehan campaign reform proposal and added that U.S. Senators Ben Nelson and Chuck Hagel are also to be commended for standing firm against the Senate version of the bill.

"We are thankful that Senators Nelson and Hagel and Congressman Terry understand the concerns held by issue advocacy groups such as ours," said Julie Schmit-Albin, Executive Director of Nebraska Right to Life. "Shays-Meehan and the McCain-Feingold bill would impose restrictions that would strip our First Amendment right to communicate with the general public via broadcast advertising during election cycles. If these measures had been in place during the partial-birth abortion debate a few years ago, television ads that ran asking pro-lifers to call their Senator about the bill would have been banned."

"How un-American is it for members of Congress to dictate to average citizens how and when they can talk about congressional voting records and issues while at the same time allowing the media free rein?"said Schmit-Albin. "In their quest to address campaign reform many members of Congress feel no compunction in trampling on the rights of citizens and issue advocacy groups, which are noticeably those persons with the least amount of money attempting to influence the political process."

The campaign reform bills would ban citizens groups from sponsoring radio or TV ads that mention a candidate, including any member of Congress, for 30 days before a Primary Election and 60 days before a General Election. In addition, the Shays-Meehan bill raises questions about the legality of a group other than a Federal PAC distributing printed literature publicizing the results of a candidate questionnaire on one or more issues which could establish illicit "coordination" between an advocacy group and a member of Congress.

CLONING OF HUMAN EMBRYOS MUST BE TAKEN UP BY SENATE

Lincoln---The cloning of human embryos by a Massachusetts biotech firm raises the need for the Senate to take up a cloning ban bill now said a spokesperson for Nebraska Right to Life.

"We all started out as human embryos. No amount of verbal gymnastics can deny that." said Julie Schmit-Albin, Executive Director of Nebraska Right to Life. "Advanced Cell Technology is boastful of their intention to create further embryos for the express purpose of killing them to harvest their cells. It is imperative that the Senate take up its version of H.R. 2505 which the House passed last July. This bill would ban the cloning of human embryos. Otherwise, biotech firms like the one in Massachusetts will foist Americans down a path to which many are opposed."

Schmit-Albin noted that the vote in the House opposing cloning was 265 for; 162 against.

"Clearly there are many members of Congress who know that the cloning of human embryos would open up a Pandora’s box in terms of ethical boundaries." she said.

Re: Resolution Approving NU Bioethics Advisory Committee Report on Destructive Embryonic Research

In December of 1999 pro-life advocates appeared before this board and asked you to stop UNMC’s use of aborted babies for research. At the time I remember invoking the slippery slope argument; that that immoral type of research would lead to further degradation of human life and I asked you, on behalf of thousands of pro-life Nebraskans, to draw a line in the sand. But that line was never drawn. We moved on to the legislative process, time marched on and here we are today, almost two years later, asking you again....when and where are you willing to draw the line?

We were put off with assurances that UNMC was aggressively pursuing alternative sources of tissue, derived from moral means. We heard about attempts to set up programs whereby tissue from miscarried babies could be gathered quickly. We heard that UNMC was throwing money into the pursuit of a rapid autopsy program, again with the goal of garnering tissue from moral means. We heard from State Senators and Regents and UNMC that all that was needed was just a little more time until UNMC could hopefully minimize its dependency on aborted babies’ brains.

When the issue of destructive embryo research began playing out in the media, in Nebraska over a year ago and on the national scene in the past few months; we saw carefully crafted answers from UNMC officials about the likelihood of it happening at UNMC. When asked if UNMC was currently doing embryonic stem cell research the reply from Dr. Berndt in statepaper.com Sept. 15, 2000, was "I know of no plans for anybody to do that." When asked if UNMC might be recruiting a researcher to do embryonic stem cell research, Dr. Berndt said, "I don’t know of anyone on this campus recruiting such an individual." When asked if someone then engaged in such research could come to UNMC on their own, Dr. Berndt said, "I’m telling you honestly I’m not aware of anybody right now, but that is not to preclude somebody coming down the road two, three, five years from now."

When Dr. Howard Gendelman was asked by the Chronicle of Higher Education in its April 6, 2001 issue, if he planned to undertake research on embryonic stem cells, the journal reported "he stiffens and says, ‘That’s nobody’s business right now.’"

During the past legislative session I posed this to a number of senators: "Does not UNMC’s cagey answers on whether they intend to embark on embryonic stem cell research negate all their claims that they are aggressively searching for alternatives to aborted fetal tissue?" Why would UNMC engage in yet another form of research that is morally reprehensible to thousands of Nebraskans?

So from two years ago to today we have come further down the slippery slope that we in the pro-life movement have invoked since 1973 when abortion was legalized. Who knew two years ago or even a year ago that a research firm in Virginia would boast of its goal to clone embryos for the express purpose of killing them for research?

President Smith has already stated that his Bioethics Advisory Committee may well take up the topic of cloning next. What will you do when that committee recommends cloning for research purposes?

On behalf of thousands of pro-life Nebraskans who are opposed to immoral research and who fear that we are now spiraling down that slippery slope faster than anyone could ever imagine, I ask you to consider what your actions will mean one or two years from now when the next moral dilemma in research confronts you.

In addendum to my prepared remarks, I would like to note: I am not confident that UNMC will remain within the framework of the National Institute of Health (NIH) guidelines proposed by President Bush which state research will be conducted on 60 past stem cell lines. I believe that UNMC will attract private funds so they do not have to be constrained by federal guidelines. Interestingly enough, James Thomson, the University of Wisconsin researcher who first isolated embryonic stem cells; had his lab set up with private funds so he did not have to follow NIH guidelines. The source for this was the recent Time magazine article about Dr. Thomsen.

Also, in the Aug. 10, 2001 statepaper.com, Dr. Sam Cohen of UNMC was asked, "Would UNMC scientists seek private funding so they can experiment on cell lines other than the 60 allowed by Bush?" His response was, "I think there will be a large number of decisions that have to be made before that could happen." Again, my concern is that UNMC is very cagey about future plans and always responds in a manner that doesn’t shut the door to anything.

NEBRASKA RIGHT TO LIFE REACTION TO PRESIDENT BUSH’S DECISION ON DESTRUCTIVE EMBRYO RESEARCH

LINCOLN--- Nebraska Right to Life is thankful that President Bush has decided not to allow federal funding of further destructive embryonic stem cell research.

"The President did draw the line at further destruction of human embryos, limiting funding to research on 60 cell lines from embryos destroyed in the past," said Julie Schmit-Albin, Executive Director of Nebraska Right to Life. "While we decry the fact that embryos have already been destroyed, there is nothing we can do to bring them back. Hopefully the President’s decision will force researchers seeking federal funding to find cures using moral means, such as the use of adult, placental and umbilical cord blood stem cells."

"We hope the President’s deliberations with regard to this issue will inspire our Nebraska congressional delegation to follow his lead and reject the notion that those most weak and vulnerable among us must be sacrificed for science."

LINCOLN-----Comments by members of Nebraska’s congressional delegation regarding destructive embryo research have prompted Nebraska Right to Life to dust off campaign pledges that were made in 2000.

"Nebraska Right to Life (NRL) prefers to sit down with pro-life politicians whenever conflicts arise and we hope to do that in the case of Senators Nelson, Hagel and Congressmen Osborne and Terry." said Julie Schmit-Albin, NRL Executive Director. "However, in light of waffling statements made by not one, not two, not three, but at least four members of our congressional delegation on the issue of destroying embryos for research; we felt it imperative to remind them of their campaign promises."

Toward that end, NRL has faxed Congressmen Lee Terry, Tom Osborne and U.S. Senator Ben Nelson copies of their 2000 National Right to Life PAC surveys, wherein they all answered "Yes" to the question, "Will you vote for measures to protect living human embryos from being used for medical experiments that would harm or kill them?"

"Unfortunately the last time we got Senator Chuck Hagel on record in a PAC survey was when he first ran in 1996, before destructive embryo research had become an issue." said Schmit-Albin. "Congressman Doug Bereuter never responds to our PAC surveys, preferring instead to send a generic letter."

ELECTED OFFICIALS’ COMING OUT ON DESTRUCTIVE EMBRYO RESEARCH NEED ALL THE FACTS

LINCOLN----President Bush’s impending decision on whether to allow federal funding of destructive human embryonic research has created a frenzy with the national media dispensing much inaccurate information. As such, a number of U.S. Senators and Congressmen have been asked their opinions and some appear to be issuing statements without all the facts at hand, said a spokesperson for Nebraska Right to Life.

"Case in point is Senator Ben Nelson’s unfortunate comment that he would support the destruction of human embryos for research as long as no one profited from it," said Julie Schmit-Albin, Executive Director of Nebraska Right to Life (NRL). "We hope that Senator Nelson will reconsider his statement, in light of what he said on our NRL PAC survey during the 2000 election. He said "Yes" when asked the question, "Would you support legislation prohibiting the sale, purchase, research and/or transplantation of fetal tissue from induced abortion?"

"Granted, our PAC survey question was not specifically on the use of embryos from in vitro fertilization, but we hope to make the case to Senator Nelson that he is already on record in opposition to the research and/or transplantation of aborted fetal tissue." said Schmit-Albin. "How can he then support research on human embryonic cells, by stating that,‘ ‘if you put the right kind of safeguards in, the answer is yes...They’re otherwise going to be destroyed.’ as Senator Nelson said in Statepaper.com on 7/10/01. UNMC PUBLIC RELATIONS MACHINE IN OVERDRIVE WITH END OF LEGISLATIVE SESSION

LINCOLN----Two announcements concerning research at the University of Nebraska Medical Center (UNMC) show the blatant transparency of the UNMC public relations machine according to an official with Nebraska Right to Life (NRL).

"The Legislature concludes its business today and UNMC coincidentally issues two major announcements with regard to the future of embryonic stem cell research and a patent for a Parkinson’s Disease vaccine," said Julie Schmit-Albin, NRL Executive Director. "UNMC’s public relations machine is now on overdrive with the conclusion of the legislative session. Rather than risk announcements regarding future unethical research while the Legislature is in session, UNMC will now have the summer and fall months to press unencumbered into new areas that pose moral dilemmas for pro-life Nebraskans."

Schmit-Albin referenced specifically UN-L President Dennis Smith’s announcement that the NU Bioethics Advisory Committee has given approval to the pursuit of research using stem cells from human embryos. This is different from the current research being conducted using the brains of aborted babies. The other announcement came from Dr. Howard Gendelman of UNMC who is in charge of the aborted baby research. Gendelman announced that he and a graduate student have applied for a patent to develop a vaccine for Parkinson’s Disease that could be tested using aborted fetal tissue.

Support for Aborted Fetal Tissue Research is Incompatible

with Pro Life Principle

A Clarification of Pro Life Principle

            Throughout the public debate over the University of Nebraska Medical Center’s research involving the use of fetal brain tissue derived from induced abortions, some public officials have tried to maintain that supporting this research is compatible with a pro-life position.  The purpose of this statement is to declare that: 

Supporting aborted fetal tissue research is incompatible with the most fundamental principle of the pro-life position. 

            The principle at the core of opposition to abortion is a belief that prenatal human beings are morally equal to postnatal human beings and deserve to be equally recognized and protected in law.  Accordingly, this principle means that killing (or complicity with killing) innocent human beings BEFORE birth is just as wrong as killing (or complicity with killing) human beings AFTER birth. 

            Based on this fundamental principle, the pro life movement opposes UNMC’s aborted fetal tissue research for at least two reasons:

  1. In order to do this research, UNMC depends upon a prearranged and ongoing collaboration with induced abortion and is therefore complicit with the intentional destruction of prenatal human beings.  Those who adhere to the principle stated above can no more support UNMC’s collaboration with the destruction of prenatal human beings than they would support UNMC’s collaboration with the destruction of innocent human beings after birth (e.g. collaborating with a professional hit man to obtain body parts from his victims).
  1. Proper consent cannot be obtained for the use of the remains of an intentionally aborted baby.  Those who adhere to the principle stated above believe that a mother who seeks an abortion cannot legitimately consent to the use of her child’s body just as a mother who conspires to kill a born child cannot consent to the use of her child’s body.

The bottom line in the moral analysis of using aborted fetal tissue in research is this: the moral arguments for or against its use stand or fall on whether one equates the moral status of human beings before birth with human beings after birth.  For anyone who believes that prenatal human beings are of equal moral status as born human beings, support for UNMC’s research using the bodies of intentionally aborted babies cannot be morally or intellectually reconciled.

             The pro life movement in Nebraska, represented by the following organizations, will work together to ensure that this clarification of the fundamental principle of the pro life position is communicated clearly and broadly throughout Nebraska and in particular to any public official who claims that a pro life stance is compatible with support for aborted fetal tissue research.

AT 10:00 A.M. ON WEDNESDAY, MARCH 21st AT CAPITOL

LINCOLN---A joint press conference of numerous Nebraska pro-life/pro-family organizations will be held at 10:00 a.m. on Wednesday, March 21st in the State Capitol Rotunda. The purpose of the press conference is to address assertions made by some elected officials that one can be pro-life and still support aborted fetal tissue research. The organizations coming together for the press conference all support LB 462, the bill to ban the use of aborted babies for research.
